How Arkansas late fees work
In Arkansas, late payment fees on commercial invoices are governed by Ark. Const. art. 19 §13; Ark. Code §4-57-104. The legal maximum is 1.45% per month (17.4% annualized). Constitutional usury cap is 17% per year on consumer loans; commercial contracts may go higher. Late fees must be reasonable and in writing.
The fee must be stated in a written agreement before the work is performed. Without a written rate, only the statutory default rate applies.
