How Louisiana late fees work
In Louisiana, late payment fees on commercial invoices are governed by La. Civ. Code art. 2924; La. Rev. Stat. §9:3500. The legal maximum is 1% per month (12% annualized). Legal rate set annually by Louisiana Commissioner of Financial Institutions (~8.5% per year recent). Conventional rate cap 12% per year unless in writing for higher.
The fee must be stated in a written agreement before the work is performed. Without a written rate, only the statutory default rate applies.
