How Massachusetts late fees work
In Massachusetts, late payment fees on commercial invoices are governed by Mass. Gen. Laws ch. 231 §6C (interest on judgments); ch. 271 §49 (usury). The legal maximum is 1.5% per month (18% annualized). Civil judgment interest 12% per year. Criminal usury 20% per year (must register to charge over 20%). Commercial contracts may set higher.
The fee must be stated in a written agreement before the work is performed. Without a written rate, only the statutory default rate applies.
