How Washington late fees work
In Washington, late payment fees on commercial invoices are governed by Wash. Rev. Code §19.52.020 (legal rate of interest). The legal maximum is 1% per month (12% annualized). Legal rate is 12% per year or 4% above 26-week T-bill (whichever greater). Written contracts may set higher on commercial.
The fee must be stated in a written agreement before the work is performed. Without a written rate, only the statutory default rate applies.
